Introduction

ListQUIK is owned by Clinton Clark and operated as part of the SafeAdZone Advertising Community. The following Terms and Conditions control your membership in the ListQUIK program. You agree that you have read and understand this Agreement ("Agreement") and that your membership in the ListQUIK program (the "Program") shall be subject to the following Terms and Conditions between you (the "Member") and ListQUIK. These Terms and Conditions may be modified at any time by ListQUIK. Please review them from time to time since your ongoing use is subject to the terms and conditions as modified. Your continued participation in ListQUIK after such modification shall be deemed to be your acceptance of any such modification. If you do not agree to these Terms and Conditions, please do not register to become a member of ListQUIK.

Due to issues that may arise with Paypal, Alertpay and/or other Credit Card processors experiencing difficulty with Credit Card payments, withdrawals can take up to 30 days longer than expected. We strive to pay within 15 business days, however in extreme cases delays are possible. It is our stated goal to reduce the 15 day payment window to a 5-7 day window as soon as practical.

FRAUD - Any member found committing fraud will lose their account, their lifetime membership and any commissions due.

If member objects to any of the Terms and Conditions of this Agreement, or any subsequent modifications to this agreement, or becomes dissatisfied with the Program, Member's only recourse is to immediately discontinue participation in the ListQUIK program and properly terminate his or her membership.

SPAM POLICY:

Spamming is strictly prohibited. Any spamming done to advertise your ListQUIK affiliate URL will result in immediate termination of your account and a forfeiture of your account balance. Incidents will be dealt with on a case by case basis.

Privacy Policy:

We do not sell or share your email with anyone else. Your direct sponsor is the only person who can contact you through our internal email system. All email advertisements from other members are sent through one of our domains, listquik.com or listquik.biz, directly to the email address you sign up with. No members actually get your email address and if you remove yourself you will not receive another email from either listquik.com or listquik.biz.

Removal or unsubscribing:

Removals or Unsubscribing can be accomplished in 3 ways: 1. Use the remove link contained in the emails sent by listquik.com or listquik.biz 2. Log into your members area and click on the remove link under the heading Manage Account 3. send a message via our help desk system and include your username or email address and ask us to remove you.

Refund Policy: Member understands that there are no refunds. Members receive access to our internal email system, which gives them the right to send email advertisements to a random number of members, depending on their membership level, for their purchases. There are no refunds even if the member has not used the email system. When an advertisement is submitted by a member we will deliver all emails as quickly as possible but generally within 7 days (typically much much sooner). Members agree not to execute a chargeback on their credit-card for  purchases, regardless of if they were used in an email advertising campaign within 180 days of purchase or not.

ListQUIK brand acceptable use policy - Members may not use the brand name ListQUIK in any way that misrepresents the company, our affiliate compensation, and our policies in any way. Members cannot use the name ListQUIK as their own username on other membership websites like Myspace, forums, blogs etc. Members cannot use the name ListQUIK as an email alias regardless of the email domain. Members are allowed to use any ListQUIK promotional material in order to promote their ListQUIK affiliate business. Members can also create ListQUIK promotional material for their own use but must obtain written permission from ListQUIK.

MEMBER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT MEMBER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, ListQUIK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. ListQUIK MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE PROGRAM OR ANY TRANSACTIONS ENTERED INTO THROUGH THE PROGRAM.

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER ListQUIK NOR ANY OF ITS MEMBERS, SUBSIDIARIES, PUBLISHERS, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE PROGRAM OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, ListQUIK uses appropriate industry standard procedures to safeguard the confidentiality of Member's personal information, such as firewall, encryption, token authentication, application proxies, monitoring technology, and adaptive analysis of the Website's traffic to track abuse of the ListQUIK.com Website and its data. However, no data transmitted over the Internet can be 100% secure. As a result, while ListQUIK strives to protect its Members personal information, ListQUIK cannot guarantee the security of any information that Members transmit to or from the participating advertisers/merchants and Member does so at his/her own risk.

This Agreement constitutes the entire Agreement between Member and ListQUIK in connection with general membership in the ListQUIK program and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this AGREEMENT is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this AGREEMENT will remain in force. No failure of either party to exercise or enforce any of its rights under this AGREEMENT will act as a waiver of such rights.
